Should Director Kevin Smith Sue Southwest?

Here's Southwest's latest blog about the incident where Kevin Smith was removed from a flight after already having been seated. http://www.blogsouthwest.com/blog/my-conversation-with-kevin-smith-0Nowhere have they publicly acknowledged that he was NOT taken off the flight for his weight, but because of their policy of "last to board, first to be taken off" - which is what they are now saying. Should he sue?

Yesterday, it was weight, as he was so told. Today, it's simple boarding policy. Hmmmm . . . so, is that the truth or CYA?

No. He has been compensated for the situation, apologies made, and he got his extra 15 minutes of fame. Why sue? Southwest is a great airline, one of the most efficient I have ever flown on. Someone made a mistake, which we all do, only this time they did it to someone who knows how to get attention about it and so he did. I hope he lets it drop.

This gets down to the question of whether he was removed for one or the other. Yesterday, it was weight, as he was so told. Today, it's simple boarding policy. I'm not trying to be cruel but this is not fair for those who have to deal with people infringing on personal space. Spirit Airlines has what they call "Big Front Seats" which consists of 2 seats on either side of the aisle. They charge a premium for them but it's a good solution for those passengers who need more room. It would be good if more airlines had that option. 47 months ago

No, he should not bring a lawsuit against the airline. You can either fit into one seat or you cannot, and if you cannot fit into one seat, you should buy two seats. That's a reasonable rule, from the standpoints of passenger comfort and passenget safety.
