Should i be getting overtime pay? cont.?

This is a continuation on one of my previous questions. I looked up the US labor laws and discovered that i am not an exempt employee.Ive been working as an asst supervisor for over 2 years with no lunch break and working holidays. i work a 50 to 55 hour work week. I brought this to the attention of our HR department and accounting department about 2 weeks ago and have gotten no response from either department. Every time i ask them about it they tell me that they are still looking into it and that it is on their list of things to do but that it is not at the top of their list or that the HR department at our corporate office has to handle this.What are my options if this issue is not handled soon?

If you really want to press it, you can force the issue by going to your State Labor Office and ask them. They will investigate and if you are owed back pay, they will make sure you get it, as well as possibly fining your employer if they did not comply with state wage and hour laws. My source is a link to each state's labor department offices. You may not be very popular with your employer afterwards, but you will get your pay if you are due any.

I haven't looked up your previous questions.

But if you are making verbal requests you are almost certainly going to continue to be ignored. And if you brought this to the attention of two different department about two weeks ago and "every time" you ask they blow you off, I'm getting the sense that you might be making a pain in the a$$ out of yourself.

If you aren't married to any of them, you should stop nagging. Being nagged is likely going to do nothing but inspire them to drag their heels even more.

You should leave them alone and do your job for the next two weeks. If you haven't heard anything in the next two weeks (you should remember that they have to deal with all of the end of year employment and businesses taxes during this period - so you nagging them during the busiest time of year for them is going to be even more irritating), give them a polite, professional and factual letter that asks for the status of your request.

Keep a copy of the letter.

But you nagging doesn't provide any evidence of anything. Written communication will.
