Slip/fall

Postby Ulrich » Wed May 28, 2014 10:55 pm

Walked into Walmart with husband.  On left display of flowers.  While talking to husband i slipped on water that was in isle next to flower display.  Caught myself while falling on the flower display.  I wrenched my shoulder, neck, back and ankle catching myself.  Husband got floor manager.  She said and i quote "There is always water around those stupid flowers".  She went to get assistant manager.  They brought a chair and I filled out a statement.  My husband took pictures of floor obvious skid marks through it.  The water was blackened somewhat and pictures of flower display that i caught myself on.  The loss prevention man was called up front and took pictures also.  I have since been to two doctors,  one said muscle strain, the other took complete exrays  and said muscle strain.  Both prescribed muscle relaxer and pain meds.  They said it would take 4 to 5 days to recover.  Well its been 7 days when i lift arm am in pain.  I am going to se another doctor to try and get rehab of some sort.  Left arm and neck very sore and when lifting or moving it just to get dressed is difficult.   I am off work at this point because I had to have surgery for skin cancer.  Will be off rest of month.  What if i am unable to do my job because of continued pain.  I work at post office.  Lots of heavy lifting and repetitive motion involved.  Should I contact lawyer here in Florida.  Unless there is great improvement cannot lift the required 70 lbs.  Employer does not know of this injury as yet.

Slip/fall

Had correspondence recently with another femail postal service employee about an outside injury.  If you tell your manager they will take you off the job. They won't let you back without clearance from the doctor. So, if you need the paycheck, recommend you go to work and get by best you can.  Sounds like good liability for Walmart and well documented.  At this point  you need to find out if you have something more serious than a sprain/strain going on. That means an MRI.  No harm in contacting a lawyer but none will take on the case unless you do have a significant injury. Hopefully, this will not be the case.  Keep in touch with Walmart Risk Management or whomever has your claim file. Nothing further to do, legally, until you know the full extent of the injury.
