sorry by my english but i don´t speak very well, i hope that you can understand that
i want to say, really i need a help so much if you can help me i will give 10 points
and 15 stars



My case is the following

my grandfather was born in the U.S. taylor texas in 1925, but in 1940 when
was the second World War, he fled of that war and arrived in Mexico at the age of
15 years about, never wanted to return to their country for fear that happen again
something like that, in that war theirs parents, brothers and their mother was
died, only my grandfather and a his sister stay alive, then he never wanted to return
to their country and married here in Mexico, he had 4 children but never wanted to
settle the nationality of they and naither to teach English to they so they could
not go to the United States and never a live experience like him, my grandfather as
a person born in the United States went to visit a few of his other family in the
country such as cousins, aunts but he never staied in U.S more of two or three days,
he did goes only to visit because he never had but the intention of returning to
his country.


My grandfather died at the age of 52 in 1977 But now that all their children
are adults, they going to the United States but as Visitors with tourist visas,
but my mother and my uncles like a sons of the citizen american or like a sons of
the one person borned in U.S now they want claim their rights and we can visit
and stay in the country without any problem or maybe stay, study or work and
they becomes a
citizens americans too.

recently went with a attorneys in U.S and we talk about our case and told us
(Especially to my mother), is a shame that you have rights by his father for
to live in U.S or become citizens americans but you can´t do it, because he
dead and if he never demanded to the united states rights for to all of you,
really you haven´t any right or possibility for to become citizens americans
or keepto live in U.S, also they commented us that like he was born
in Texas but exactly to 15 years he arrived and lived in Mexico, there is a U.S.
law says that if a person was borned in the U.S but that person not live or
stay in U.S when has 15 years old until to 20 years that person is not considered
a citizen american although he had borned in U.S, then they told us could not do
anything to us or rather, to my mom and my uncles to arrange theirs rightful
citizenship rights, that is it true.

Please answer me and if you give me a
solution and tell me how we can make
for to solve this situation i will give to you

Your grandfather's children could claim to be U.S. citizens based on jus sanguinis, the legal principle that transfers citizenship from parent to child via the blood.

There are 2 problems:

1) Your grandfather is dead. They would have to dig him out of his grave and proof that he's indeed the natural father. That cost mucho dinares!

2) In order to transfer citizenship back then, your grandfather needed to have lived in the United States for at least 10 years before his children were born, 5 or which needed to be after his 14th birthday. If he fled to Mexico at the age of 15, that is not possible.

Therefore, I do not see any chance for your grandfather's children to claim or get U.S. citizenship.

Sorry but attorney general is right nothing you can do because he didn't petition for citizenship for his family your not US citizen only if a living relitive of his will sponsor you you can apply for green card

The lawyer is right. You have to get citizenship the hard way and apply for it with the test.

Or you can go to another lawyer and keep looking for other ones in hopes that they will tell you what you want to hear, which won't be correct regardless.

If they have overstayed their tourist visa, then they are subject to arrest and deportation at any time and are illegal immigrants. A tourist visa doesn't entitle you to stay more than a few months

The lawyer was correct you grandfather is deceased he cannot file
for his children to live in the US ..

if he was a proper Aila lawyer and not a notario believe him
you can always get another opinion
