Speeding ticket question. (I was never handed an actual ticket)?

Postby giulio » Mon Apr 30, 2012 11:53 am

I got pulled over in my town the other night for doing 44 in a 25. When the officer comes back to my window he explains my ticket, has me sign it and everything, then gives me my copy. I get home and look over my ticket and it's completely blank. Not even a ticket actually it was a form to fill out if I wouldn't have shown proof of insurance. So I am wondering if i should just forget about it or should i call someone? Call a lawyer? Any info would help thanks.

P.S. dumbass cops.

Call a lawyer, just because you don't have your copy doesn't mean it doesn't exist. It will be on police records and will need to be paid.

Don't call a lawyer - that'll cost you more than the ticket!

Take what you have into a police station and ask them to clarify.

"Dumbass Cops"?

What about 'Dumbass Ben"? He's gonna have a judgement against him if he doesn't follow up and either pay his fine or find out his Court date and get a lawyer!

Speeding tickets are all handled by software now...the Officer keyed in your ID and your offense code & details and HIS part was done...

Did you SHOW him proof of insurance? He may have been giving you the opportunity to provide proof 'after the fact' if you did not have it handy, or if maybe you were driving somebody else's car?

Yes you should call a lawyer (if you have an excuse for doing 44 in a 25), but FIRST you should call the Courthouse* and find out what your Court date is...

You might also want to hurry up and take a "Defensive Driving" Course, they are EXTREMELY expensive, but if you take a certificate of completion to Court with you, they MIGHT not report your offense to your Insurance provider, and thus avoid the Premium penalty for driving at 19 MPH over the posted limit...

If you signed it, you are cited and the missing copy is a procedural issue. The officer can claim he handed it to you and you lost it. 44 in a 25 can be serious since it is more than 10 over and even higher than 15. Lawyers are expensive and often not worth the cost but you are looking at insurance premium hikes and points on your license in most states. Start at the police station and have them get a copy of what you signed (both sides of the ticket) or the original copy from the officers book. I would aim at any defense of the actual charge more than the procedural goof unless a lawyer can pickup something from it. Its not something you would argue yourself. In a small town it could be either the Motor Vehicle administration or a local court handling it. Maybe you can get a guilty to a lesser speed or charge with less penalty. Lawyer? Maybe. This is going to cost you one way or the other. The ticket exists since you signed it.

That ticket still counts -- they still have a record of it
