Statute Of Limitations

Postby Rutledge » Thu May 15, 2014 12:11 am

Anthony,

Statute of Limitations is the period of time in which you have to file a claim or a lawsuit within the State or Federal Court where you live if you live in the United States.

As an example without providing legal advice, in Arizona a claimant usually has two years from the date of an accident to file a lawsuit.  If the claimant is a minor, that person has two years from the date he/she reaches majority(18 in Arizona).  If the responisble party is a municipality, however, a claimant has 180 days to file a Notice of Claim and must file a lawsuit within 1 year.

Each State is different and I would urge you to contact local counsel with any direct questions.

Very truly yours,

Paul D. Friedman, M.A., Ph.D., J.D.
