Sueing A Drug Company?

Postby Gleann » Fri May 09, 2014 1:14 am

I was administered a antibiotic drug when I was 14 years old, it caused a severe allergic reaction, which lead into a severe auto immune deficiency, which lead to a host of other problems. The conditions have gotten continually worse over the years, (I have all medical records).  I'm now 21 years old, and I would like to bring a suit against the drug company seeking compensation as my condition caused by the drug makes it nearly impossible to work. My question am I able to file a suit now, or is there a statue of limitations? If so are their any exceptions or special circumstances etc.?

Usually, the law of restrictions for children stretches a specific amount of period past their 18th birthday. But often merely a couple of years and that I think it is just 24 months in Pennsylvania. You might currently be time-barred from getting suit. But-don't depend simply on my estimation. Consult with a personal injury lawyer and atleast confirm whether that is true.

First you have to understand that simply having an allergic reaction to the drug does not mean anyone hs done anything wrong. Every medication has side effects. If this was a known side effect and your parents were warned of the possibility, there's really o action to take.

Being sensitive to some medication is the bodyis problem with it; it's nothing related to the pharmaceutical business.  They've no method of forecasting who'll be vulnerable towards the medication from an allergy viewpoint.   auto-immune illness can also be not the duty of the pharmaceutical business.  Medical technology nevertheless hasn't decided precisely why many people get car immune illness yet others do not but usually in ladies it's associated with hormone: adolescence, providing a young child etc.  That appears to trigger some string of occasions leading to auto-immune.  the title "car" indicates from within.  Anything inside the individualis body goes awry and begins the string of occasions.   Also, Port is proper:  the law of restrictions for somebody who endured damage while a small is 2 yrs from their 18th birthday so that your law to create a match ended atleast this past year if you should be 21.  You're time-barred from getting an incident today.  even when the drugstore company had some responsibility you waited too much time to do this under Pennsylvania law.
