Tenants smoking smell?

New tenants moved into a new renovated apartment. In the contract it stated the apartments were non smoking apartments. The apartment has it's own private terrace . However tenant told me that they had been smoking in the flat due to weather conditions * rain * and now we notice the smell of the cigarettes filling up the communal area=. I know that it is not against the law to smoke in the flat but it is stated in my agreement its a non smoking building. Yet they have decided to go ahead and smoke. What type of letter would i NEED to give them about this.

Any ideas very welcome

A three strikes warning and their out! I hate when I smell cig smoke in the hallway on my floor when its a smoke free building! Smells even worse when your a non-smoker.

A three strikes warning and their out! I hate when I smell cig smoke in the hallway on my floor when its a smoke free building! Smells even worse when your a non-smoker.
With respect you should have asked whether or not they were smokers before you took them on. Smokers will always smoke indoors if they can get away with it. So in my view you are stuck with the problem until the end of the contract. Eviction is too costly. A letter will be a total waste of time.

If your signed agreement indicate the buildings are non smoking buildings then you would have the legal means of evicted them for lease violations. It matters not that you knew they were smokers prior to them moving in.

The fact they signed the agreement indicting that the buildings were non-smoking should be sufficient to give them a notice that they are in violation of the written agreement and would be evicted for continued smoking in or around the buildings.

You might issue such a notice as they have admitted to smoking in the building because of rainy conditions that prevented them from smoking terrace. It would seem that there would be no smoking anywhere in or near the buildings if your contract is as you stated this would be a none smoking business.

Why would you think tenants would be able to smoke in the flats if the building is non smoking. This is sort of a contradiction of terms.

If I pay rent for somewhere, I expect to be able to smoke in it. Landlords have no right to insist on non smoking dwellings, as long as the tenants are careful and open a window it isn't any of your business.

You'll be telling them not to fart next.

Sounds to me like this would be grounds for eviction. They have violated the lease.

I'd go ahead and start eviction proceedings. Then you can replace them with a non-smoking tenant.

I'd also consult with an attorney and find out if you can charge them for extra cleaning/steps that have to be taken to get rid of the smoke smell. Not normal cleaning/painting you have to do between tenants, but for other steps that have to be taken to erradicate the smoke smell/damage to the unit.
