Time away from work for salaried employees?

I am a salaried employee. My boss wants me to use vacation time for a doctors appointment; however, I typically work well over 40 hours per week. What does Texas Labor Law say about this? I have been told that a two hour doctors appointment should not be applied against my vacation since I am salaried not hourly. Someone told me that as salaried that my boss can only use vacation in 8 hour increments. Does anyone know what is truly the law?

As an exempt employee, your employer is not allowed to dock any portion of your pay for the day, if you work during that day. The employer is allowed to supplement the missed time with sick or vacation time.
- What this means, is if you have time accrued vacation/sick time you can be required to use it. But if you don't have any vacation/sick time and you take time off, the company can not reduce your pay for that day.

Additionally, it's up to the employer to determine in what increments they want to record the time. Typically, it's in 4 or 8 hour increments but could be as little as 1min increments, if they wanted.

Most employer's do not require exempt employees to supplement pay if they are taking a couple of hours off. Why don't you ask your boss about making the time up during the week. I know you are already doing this but it will just bring the conversation to where you want it to be - you work over 40 hours so let's not nickle and dime everything.
