They must be kept 3 years for the federal government FLSA rules for the inspection of the Federal government if they audit.

MOst of the states also go with 3 years some are different those are listed below.

Arizona is 4 years

New Jersey and New York is 6 years

Kentucky and Louisiana is 1 year

California, Colorado, Massachusetts, Vermont, West Virginia, Wyoming is 2 years

Alabama, Florida, Georgia, Hawaii, Indiana, Iowa,Montana, Nebraska, New Hampshire, North Dakota, South Dakota, Oklahoma, Puerto Rico, Tennessee, Texas, Mississippi, Virginia have no state provisions.

South Dakota just says a reasonable time

The records should be easily accessible in case of an audit.
