Trademark or how to protect an invention?

Postby montgomery69 » Sat Nov 19, 2011 2:56 pm

I was wondering if I came up with a simple idea and wanted to sell it, how would i go about protecting it. My idea is just a combination of simple ingredients that you find in the kitchen, and I heard that some things cannot be patented.

But I was wondering if I could get full protection under a trademark, from people taking the idea and calling it their own.

Any assistance is greatly appreciated.
Thank you

Trademark or how to protect an invention?

There are certain criterion that you have to go by to qualify for a patent and/or trademark --
You can go online to the US patent Office website and see if your idea qualifies -

Some things can not be patented - One criterion is that if one thing is changed - then the patten isno good - so you could not patent something like a recipe - unless it is so uniqued (like Coca-cola or KFC chicken) - then you can protect it as "intellectual property" - but you can't patent "flour, sugar, spices, etc" -
Legal Zoom might can help you - or find a patent lawyer - for a price -
A Trademark - is just a "name" or logo that you use - you have to be issued a Trademark license if you are going to be using the name across state lines or to protect your "name" -- but you must use it in commerce with in a certain time- show where you have orders or have sold across state lines , etc.

Good luck -
