Its been a few months and they haven't paid anything. Brother told them to leave and they won't. We served a 5 day notice and told them we would file a forcible detainer if they weren't out in 5 days. The Squatter said we can't do that because they don't have a rent agreement. The oral agreement was they would pay $300 a month rent. Also my brother found some of his stuff in an unknown backpack hidden out in the yard. Can we just call the police and have them removed for trespassing. We're afraid if we wait for the judgment they'll steal more stuff.(this is in Arizona)

Laws The laws are different for this situation in every city, state, wherever. For that reason it's tough to answer. From where I'm from, if they have a bill comming to them at that address then you can't throw them out without going through the courts. No agreement, no mail, I would wait till they leave, change the locks and throw their stuff in the street. When they come back, you call the police. Check your yellow pages for a company that deals with renters like this. We pay them every month for when something like this happens(almost like insurance). I would definitely call the police, explain the situation to them and get them out of there as quickly as possible. Try the legal road for this matter. Since you are the homeowner and they don't have a legal written lease you can file in court for a eviction which will take up to but almost never exceeding 90 days. The cops will not remove them for trespassing if they have been recieving mail at that location because that will make them residents.
