Utilities, separation, and community property?

Postby gillivray5 » Wed Apr 06, 2011 5:05 pm

I left my abusive ex husband in 2004 and he then had some utilities turned on on my name and then skipped out on the bill some months later. I managed to get a couple discharged, but the gas bill is still giving me trouble. The gas company says that, despite the fact that I never lived in the home he had these utilities on in, the fact that were were still married (but separated) at the time makes this bill my responsibility due to Arizona's community property laws regarding bills and marriage, and that I shoud have known that. None of the people with the gas company I have talked to are able to provide me with the Arizona statute that states this, and I can't find it online. I found various other statues regarding community property, but none apply to this. If you know the statute number and maybe some details it would be greatly appreciated!

Unless you were "legally" separated, you would still be liable for the debt.
