Wage problems in the UK?

Hi everyone. My sister has been working hard for 6 weeks at a local garden centre. During her interview, she did not have a full UK passport or full birth certificate. She did have an old passport, one of those receipts of entry into the births registry and her national insurance card.

Now, she is supposed to be paid on Christmas eve, but now after 6 weeks, they are refusing to pay her until they see a current passport or full birth certificate. Here contract does state that the position "is subject to receiving either your passport or birth certificate with national insurance number", exact quote.

Should she argue this, should they have even started her in the first place without seeing this documentation? My other sister works there and has proven all this in the past, they are quite clearly sisters and live with my mum and dad at the same address.

It's comes across to us all that it's quite a simple minded ploy to refuse to pay my sister for the work she has done, or at least delay paying her over christmas. It's seems they are ignoring the spirit of the law and abusing the letter of the law for their own purposes.

Any replies would be great.

An extract of entry, a national insurance card and an out of date passport should suffice. You have to prove who you are thats all.

Your sister has had 6 weeks to sort this out and has not been bothered to do so. The employers are following employment laws that are in place in the UK and can be prosecuted for not following the correct procedures. She has nothing to argue about, she has signed the contract and ignored it.

well if it states in her contract that she wont be paid til they see her passport then she needs to provide a passport. maybe she should have read the contract before signing, she only has herself to blame
