Am I eligible for a medical malpractice case?
April 10 of this year 2012 I was involved in a car accident. No other drivers were involved, I lost my breaks and drove over a 40ft embankment. I broke my leg, luckily that was all that happend. Well, I had to be put on propifol at the hospital for them to be able to set my leg back in place and after that they had to put me to sleep to put my leg in a cast and further stabilize it. At the time I was 28 weeks pregnant and it can be very dangerous to be on a lot of medication while pregnant especially to be but asleep but the orthopedic doctor and my OB doctor reassured me if would be the last time I had to be put to sleep so it would be okay just the one time. Well everything went well in the hospital and I was sent home after several days, they put me on a low blood thinning medicine to be safe. I go home and shortly after my leg starts to swell out of my cast, it literally was trying to break through the cast it felt. I rush to the emergency room, not knowing if the swelling was due to pregnancy or what. The ER doctor Xrays my leg and tells me the leg looks perfectly set and since it had been a week since I had the cast on that there was a good chance my leg was stable enough for him to get it out of the cast. He cuts the top of my cast off and sends me to get an ultrasound done to see if I have a blood clot causing the swelling. The ultrasound starts off with them checking my thigh and upper leg (I broke my tibia and fibia of my lower right leg) the man doing the ultrasound then tells me he has to remove my leg from the cast to do an ultrasound around the break and behind me knee. I told him that it was too painful to move my leg, I didn't have any medication at all and the ER doctor had only cut the top off my cast he had not loosened from the cast yet it was still swollen into the cast. The guy doing the ultrasound said I HAD to do it that he must get an ultrasound around the front AND back of the break. I kept arguing with him to please not do it my leg was in horrible pain and I told him that blood clots usually form above breaks when it's due to a broken leg I also told him being in a lot of pain was dangerous for my unborn child because it could casue me to go into early labor (I had gone into early labor while waiting on the ambulance but the doctors stopped it). He would not listen to me and started to grab the back of my knee and my toes to lift my leg from the cast. I told him not to because my shin bone was broken in two the way he was grabbing it would cause the two bones to buckle in the middle, he said that the swelling was too bad for his hand to fit in my cast so he had to pick my leg up in those places, as soon as he starts my leg starts to give, I start screaming and crying for him to stop and he apologizes and says he has to get the reading I told him to leave it the he** alone I would just deal with not knowing if I had a blood clot it wouldnt affect anyone but me. He completely ignores me! He chuckled as if I was being humorous and pulls my leg another time and my leg re-broke. The pain was just as bad if not worse as the first time it broke. I screamed and cried and thrashed in the hospital bed. This man had the nerve to then drop my leg, from 6inches above the bed and throw his hands in the air he held them there like I had a gun pointed at him. He pushed his chair away, picked up the phone, dialed to speak with someone in the ER and then, after me asking him several times to not do the ultrasound, he turns to tell me "We don't have to proceed it's not worth causing you the pain, the doctor says as long as the reading shows your deep vein in your thigh and groin that' all he needs." I could have killed him, I had begged him to check before moving my leg. Either way I was wheeled back to the ER I told the ER doctor that he rebroke me leg, and they said oh it hurt a little i'm sure but your Xray earlier shows your leg to be stable you will be fine. He starts to try to splint my leg for them to bring in an AirCast so I won't be put to sleep anymore for recasting, he removes the bottom plaster, I began screaming, crying, passing in and out from the pain the doctor grabs the old plaster from the floor and sticks it under my leg. He steps away and says "I don't understand your Xray shows your leg to more stable than this" He sends me to be monitored for early labor, I get an Xray the next day showing that the ultrasound man DID rebreak my leg, they finally give me medication, after several days i'm transfered to another hospital where they have to put me asleep and do IM nail surgery on my leg due to the leg being unset I have to be put back to sleep and given EXTREMELY strong pain medication that may harm my child AND from the old plaster cast I was put in I developed an ulcer. Sorry for the length of this story but do I have a good Medical Malpractice case or was all that suffering ju

Please proceed with this. It's like reading a horrorstory. But you have to keep focus on the malpractise which is the ultra sound guy. That they had to give you pain meds and anesthetic is to take care of you. But I can't believe he rebroke your leg. It's grotesque.
