Washington State law on termination of residential tenancy?

Washington State law on termination of residential tenancy?

Postby denys » Tue Apr 05, 2011 9:32 pm

I am renting a home on a month-to-month rental agreement in Washington State, it's out of the city of Seattle so it does not fall under their special landlord/tenant laws. It is governed by the Revised Code of Washington (RCW 59.18).

My landlord has posted a termination of tenancy notice on my door. The law in Washington State says the landlord must give at least 20 days notice. I was home on the 10th and left for the weekend at around 5pm and returned on the 12th to find the notice. I do not know what day the notice was posted, I only know that I saw it on the 12th which falls short of the 20 days notice.

Is this the proper way to give notice? Since I didn't notice it until the 12th, that makes it less than 20 days notice. Is she supposed to have someone else (independant third party) post it or can she do it?

Thanks for your time.

That argument will not hold up in court if the landlord has to evict you as you said you do not know when it was posted.~
