What are my options on my wife's used vehicle?

Postby christos » Thu Nov 24, 2011 6:42 pm

My wife purchased a 2008 Dodge Nitro RT on the 21st September 2011 (on finance) from a Dodge dealership. Within 2 weeks the engine warning light was on, we took it in and they said it was the gas cap. They cleared the light and 2 days later it came on again so we took it back and was told the same thing and the dealership said it will most likely come back on so if it does bring it back as they may have to check the fuel line. Last week it came back on so we made an appointment to take it to the dealership and they have now said it will cost $136 just to find out what the problem is and the so many $$$$$ to fix it.

I am wanting to know what rights do we have? Do we have to pay even though the problem occurred within 2 weeks of purchase (less that 200 km driven in that time), or should the dealership repair the problem. Would this come under the fair trading act or any other consumer act, or do we just have to suck it up and never buy a Dodge again.

P.S The car had 128,000 kms on it, but the manufacturers warranty is only good for 100,000 kms

Any help would do

Thanks
christos

did you buy the car as is or do you have a warranty? I would start by putting a new fuel cap on

You really don't have any inherent rights other than the ones that you signed for when you bought the car. Since the factory warranty is expired, you don't have that coverage. Was this vehicle a certified used car or part of a Dodge used car program? If so, you have the coverage associated with that plan. If not, you completed an as-is transaction and could be billed for the services. Is it good business fot them to do this...no. But they can.

Try to confirm it from a lawyer he may help you better than anyone, or otherwise have a look at the applied laws of your country what they said regarding your situation in their books.
