What are NYS labor laws regarding this situation...?

My brother and I both work(ed) at Ruby Tuesday. I've only been there for about 2 months. Today, I was apparently scheduled to work, but didn't know. When my boss found this out, he fired me and my brother.

Now, I was never given breaks on my shifts, even the 12 hour shifts.

I was never told that I was supposed to work today. Apparently, the schedule was posted after the last time I worked, and I thought I didnt have to work until tomorrow. This means I would not have been able to see the schedule until tomorrow.

I was never given fair training. I was never told where anything was stored in the kitchen, so on the only day I had to cover the shift of Salad Bar Attendant, I had no idea where anything was. Of course, they HAD to put me on on the busiest day of the week without telling me where anything was. The whole time, I had a hard time finding most of what I needed to do my job, even with other employees helping me. I got written up that day for "Not working fast enough".

So, can I bring any charges against Ruby Tuesday or my managers for any of this? I know it sounds almost trivial, but it seems extremely unfair to me that they treat my brother and I like a unit, and that I was penalized for doing my best when they didn't train me. Also, I'm still pissed about not getting any breaks on my shifts when other employees often got opportunities to stand around doing nothing, whereas I never got a chance to rest.

You could sue but you won't win. Just chalk it up to a bad experience and move on.
