What are the chances of battling this Ticket?

Postby jomei69 » Wed Dec 28, 2011 10:46 pm

Just got into a car accident recently. I made a right, on a yield sign, the light was in yellow, traffic has stop. so I made a turn, when BANG. I felt I got hit. Up look, car hit and run. A witness saw the accident and wrote down the license plate # for me. When cops arrive. I told him, I made it through the intersection when I got struck, wasn’t sure where it was coming from. My witness told him. He saw that I came from west, made a turn. Made it passed the yield sign. When the other car made a left from the east and hit me. then the car took off.
Anyways I got a fail to yield ticket. I felt like the officer didn’t wrote down everything that was said, my witness told the officer that he saw the other car “tried to run a light” reason why he hit me.
Anyways I decided NOT to pay for the ticket, bringing it to court. I’m gonna tell that judge that I DID yield. And my witness willing to go and tell the judge about the accident. He also saw that I DID yield. but the police report matters the most.
How would likely happen?

Well, your story makes no sense. If you'd yielded, you'd not have been hit. Based on your current story, your chances are roughly 0%.

You didn't yield. The proof of this is that you got hit. You are only supposed to proceed on a yield sign if the road is clear of other vehicles.

Some people regard yellow lights not as "caution-slow down" lights, but as a challenge to make it through the intersection before the red light appears. They are wrong...but still, you are supposed to yield to them.

if you did yield then you would not have been hit. the other person had the right of way and he hit you because you did not yield to him/her. you are at fault. UNLESS you can absolutely prove that the car ran a red light then you might be in the clear. but you CLEARLY say here that it was yellow. so you probably wont win. you cant just decide not to pay. thats not an option.
