A friend of ours is being arrested for writing a $300 check in a closed account. In Indiana, check fraud is a Class D felony with up to one year in prison and/ or $5000. But the codes were very vague and we would like to know what the offense would be for a first time offender? He has no criminal records at ALL, and is overall good natured in character. Our plan right now is for our friend to plea guilty and deal with plea bargains, which right now we are fighting to have a sentence to pay the fine of $300 and be under probation. We would like to know if we can have better details on the laws in Indiana.
