What do I have a case for?

Postby lawly1 » Wed Aug 01, 2012 11:20 am

I'm from Ohio and am trying to find out what my possible legal actions are for the following event. Any help, advise, topic would be appreciated.

I've been donating Plasma at a plasma center in my city since November 2010. I guess you could consider me a sporadic donor because I only donate twice in a month and towards the end of the month. This money is used to provide necessities for my home during the ending weeks of the month. When I was first screened to donate plasma my physical, It was explained by the Nurse, how everything happens, how the payment system works, etc. I was told that I could donate again as long as I put a twenty for hour period. Payment was explained as after your first donation, you're paid 20 dollars. On your second donation in a 7 day period as long as you put 24hrs in between, you would be paid $35.

On Friday July 21st, 2012 I went and donated. I was paid $20. I could not donate Saturday (24hrs), Sunday they are closed. Monday and Tuesday, I spent at home. Wednesday, the 25th, I return to donate. Once I completed the donation, I was paid $20. I asked the clerk to speak to the manager regarding the discrepancy of $15. I was first told that regardless of me donating twice in the seven days, their pay week reset on Monday. I explained that's unfair because that means anyone who donates on Fridays or Saturdays are excluded from ever getting the $35. He said, that people can return on Monday. Which I replied back with the pay-week resets on Monday, I thought.

At this point the manager turns and walks away from me and I'm trying to ask the mans name to know who I just spoke to and he continued on. On Thursday the 26th, I called Biomat to attempt to speak to someone above the guys head I spoke to.

Again, I went over the same thing, and they replied back the same thing. But this time, he went on and even said more. What he said to me was that their pay week resets on monday, and that people who donate on those days can come back on Tuesdays, and Wednesdays. Which means he slipped up and admitted I'm correct. Of course that is not recorded, however, my payment records could clearly show dates in which I've previously donates on Saturdays and Donated on Fridays and was paid correctly.

This is all over $15. I've contacted legal aid for assistance online to get legal advice regarding this. Losing out on that $15 resulted in me having to borrow money from family for $11.

Just want some advice and ideas on what to do. Please keep the negative comments down, I'm reading these and people can be so cruel sometimes.

I suggest that you stop donating blood and get a job.

You can feel free to sue them in small claims court for your $15. The filing fee will be several times that but that doesn't mean you can't go for it.

$15? Stop dealing with them if it bothers you. Trying to get around their own rules is pointless, since they have the right to decide on their payment rules.

Unless there is something in writing about paying $35 if you donate twice within 7 days you appear to be sol. If there is something written that says you get $35 for the second donation within 7 days get a copy of it and a copy of whatever you have to document that you donated twice within 7 days then approach whoever is running the donation center and present him or her with the documentation. Their pay schedule should have nothing to do with you getting properly compensated. Don't be afraid to go over the Plasma Ctrs head and contact their home office to try to resolve the problem. You should be able to locate them via an internet search. Good luck.
