Postby clem84 » Wed Apr 06, 2011 5:38 pm

I have a logo and business name for a material product that is not a new material but the use and application is new and unique, and I want to market and sell this material but want a way to protect my rights ,idea, use and name for the product once it hits market because the material is readily available for anyone to market themselves.I live in Canada and I want to market this in Canada and the US do I need a patent, a trademark, a copyright, or registered trademark to protect my logo, name and anyone else copying the idea and use for selling my product?

logos are usually trademarked [ (tm) to start] and unless you get a registered trademark (R) , it is not 100% protected

US copyright and Trademark office has a website - probably something similar in canada

In the U.S., you can trademark the logo and the name. As for the patent, it all depends on what you mean by material, In many cases, the material will be under patent and you may be opening yourself up to patent infringement by using the material without license. If you own patent on the existing material you are on safer ground, but if not, almost anyone could buy the existing material and use it the way you intend. Your best bet is to consult with a patent attorney to see if filing a patent is a wise use of funds and the chances of you winning a patent suit if you do.
