What should I expect from a personal injury settlement?

I was just in a car accident this last month. I suffered an injury that has caused me to seek treatment from my doctor and now requires a specialist ( oral maxo-facial surgeon ) to assess my situation. My incident is well documented. I attempted to work with my other parties insurance company, and they are never returning calls, ignoring my requests for assitance with a rental car ( despite the other party admitting fault, admits to running a red light.. and the insurance stating they'd pay for repairs etc.. )

I decided to get an attorney to help me with this due to be head ache for payment of medical bills, meds, pain and suffering etc.

My injury may indeed be with me the rest of my life.... and may require surgical intervention, depending on MRI results etc...

My big question.. what should I expect to see as far a settlement. ( not so much $$ but percentage of monies collected.. and possible money in original settlement offer )

Nobody on Answers could possibly answer this question.

This is what you get a lawyer from.

Your lawyer will be able to give you a prediction based on the specific facts of your case, and his/her knowledge of your local court system AND the other party's insurance company.

But I will say that you don't get a dime based on what "may" happen in the future. You can get your actual out-of-pocket expenses. You cannot get money based on an injury that "may" be with you for the rest of your life or "may" require surgical intervention. Pain and suffering is generally 1/3 of the cost of the medical bills.

Your attorney will collect 33% to 40% of you end settlement PLUS costs. (So if you have a 40% contingency fee agreement and you end up with a $100,000 settlement, your attorney will take $40,000 right off of the top plus as much as $10k to $20k in costs (the amount gets quite high if your attorney has to retain an expert medical witness).

It all depends on the Lawyer, the Judge, and the Jury.

You could get nothing, or you could get $100 million
