What would happen if i got in a reck in my moms car witch is insured but im not listed as a driver?

Postby calin » Thu Aug 02, 2012 5:05 pm

My car was insured by my dad who was paying the liability insurance on it. Times have got tough and hes unable to help me out with it anymore so my mom has stepped in to help until i can find a job that pays enough for me to handle the bill on my own. We just got the car insured on her insurance but im not listed as a driver on the insurance because im 18 years old and I've got a bad speeding ticket still on my record from a stupid mistake i made a year ago. If i where to get into an accident without being listed as a driver on the insurance what would happen?

Unless you were specifically excluded from coverage on the policy, the claim may be paid, however the insurance policy then probably would then canceled. Specific details are needed to state exactly the consequences, and a legal case may be involved depending there upon.

The answer depends on which state you reside in. Some states (like Massachusetts and California) require that every person in the house over the age of 14 be listed on the insurance policy. So if you drive the car and you are not on the policy you might not be covered for damages and the claim could be denied. And then they would likely cancel the policy for failure to disclose.

If the car only has liability insurance and you cause an accident, this means any damage to your Mom's car would NOT be covered by the liability insurance - only the damage to the other car would be paid for. (If the accident was the other person's fault then the damage to your Mom's car would be paid for by their insurance company once they accepted liability.)

Good luck.
