When does Arizona over-time law kick in for Holiday weeks?

Postby arvad » Wed Dec 21, 2011 3:20 am

Hi,

I am an independent contractor and I get paid through an agency. The contract states "overtime, if any, will be billed according to state law." On a normal work week, over time kicks in at 40 hours. However, we have Thursday and Friday off (but I am not paid, as I am hourly and not paid for days off/holiday). Does this mean overtime charges will apply when I reach the 8 hour, 3 days amount (aka 24 hours)?

if you have an agency you are probably NOT actually an indie. in any case, holidays do not affect the point at which o/t rules appy. its not o/t until you break 40 for a week (or maybe 10 for a day? idk). even if it is o/t, the rate does NOT neessarily change. i'm a contract software engineer and under federal law, given my base rate, I need not be paid anything greater than straight time for ALL hours. a higher rate is not prohibited but is not required and MY agency doesn't do it.

Same as any other week, at over 40 hours, not 24+.
