plus, it is just plain stupid.  Seat belts are designed to work in a specific manner, based upon being at a certain place on your body.  The inertial locking safety system may not enguage if the shoulder harness is in a different place.   If they are not properly installed, maintained and used, they will be ineffectual, and some dumbass will try to sue the car company because they got inhured while wearing it inproperly. http://www.ai.org/legislative/ic/code/title9/ar19/ch10.html IC 9-19-10-2 Use of safety belt by motor vehicle occupants; safety belt standards      Sec. 2. Each occupant of a motor vehicle equipped with a safety belt that:        (1) meets the standards stated in the Federal Motor Vehicle Safety Standard Number 208(49 CFR 571.208); and        (2) is standard equipment installed by the manufacturer; shall have a safety belt properly fastened about the occupant's body at all times when the vehicle is in forward motion. As added by P.L.2-1991, SEC.7. Amended by P.L.214-2007, SEC.7.

Indiana Seat Beat Law Indiana Seatbelt Laws      Current Seat Belt Law   IC 9-19-10-2 Each front seat occupant of a passenger motor vehicle equipped with safety belts must be properly fastened when the vehicle is in forward motion. Child Passenger Safety Indiana Child Passenger Law Children are required to ride properly restrained in a child restraint, which can include a belt positioning booster seat, until they reach their 8th birthday.(This does not include shoulder belt positioners.) If at court proceedings, a driver who has received a violation under this code possesses or has acquired a child restraint system, the driver is not liable for any costs or monetary judgment if the person has no previous judgments of violation of this chapter against the person. Fees collected from violations will be entered into a fund to purchase child restraints for low income families throughout Indiana. Exemptions: If all lap/shoulder seat belts are being used by other children, then a child over 40 pounds may ride in a lap only seat belt without a child restraint.(Booster seats cannot be safely used with a lap only seat belt.) This chapter(9-19-11-1) does not apply to a person who operates any of the following vehicles: A school bus. A taxicab. An ambulance. A public passenger bus. A motor vehicle having a seating capacity greater than nine(9) individuals that is owned or leased and operated by religious or not-for-profit youth organization. An antique motor vehicle. A motorcycle. A motor vehicle that is owned or leased by a governmental unit and is being used in the performance of official law enforcement duties. A motor vehicle that is being used in an emergency. Children at least 8 years old until their 16th birthday are required to ride properly restrained in a child restraint system or seat belt in all seating positions in all vehicles. Law effective July 1, 2005 Children 16 and older(& adults) are required to ride properly restrained in a seat belt in the front seat in passenger vehicles. If not in letter, it is a violation of the intent of the law. a lap/shoulder seat belt is designed specifically to drape across the shoulder, and if worn improperly, can contribute to additional injuries in an accident.  I know that some people object to the feel of the shoulder belt against the side of their neck, as they drive, but nonetheless, it needs to be used as it was designed to be used.  there are various pads and clips that can help keep the shoulder belt comfortably placed, and not interfere with the function in an accident.    In conclusion: if Indiana law states that seatbelts are to be used properly, then it is an improper use to tuck the shoulder belt under your arm, and therefore illegal.   proper use of a lap/shoulder belt is with the lap belt riding low in the hips, and the shoulder belt draped over the shoulder and across the torso.  allow the seatbelt retractors to keep the lap and shoulder belt snug, but it does not need to be held tight under normal driving conditions.  the drivers' seat should be placed as far back as it can be while allowing the driver to comfortably manipulate the controls, and the driver should be in the habit of driving without unduly placing his(or her) hands and arms across the center of the steering wheel(where the airbag is)  for this reason the traditional "10 and 2" hand position has been amended to "9 and 3" Sources: this safety message brought to you by a North Lincoln Fire and Rescue volunteer.
