If not in letter, it is a violation of the intent of the law. a lap/shoulder seat belt is designed specifically to drape across the shoulder, and if worn improperly, can contribute to additional injuries in an accident. I know that some people object to the feel of the shoulder belt against the side of their neck, as they drive, but nonetheless, it needs to be used as it was designed to be used. there are various pads and clips that can help keep the shoulder belt comfortably placed, and not interfere with the function in an accident. In conclusion: if Indiana law states that seatbelts are to be used properly, then it is an improper use to tuck the shoulder belt under your arm, and therefore illegal. proper use of a lap/shoulder belt is with the lap belt riding low in the hips, and the shoulder belt draped over the shoulder and across the torso. allow the seatbelt retractors to keep the lap and shoulder belt snug, but it does not need to be held tight under normal driving conditions. the drivers' seat should be placed as far back as it can be while allowing the driver to comfortably manipulate the controls, and the driver should be in the habit of driving without unduly placing his(or her) hands and arms across the center of the steering wheel(where the airbag is) for this reason the traditional "10 and 2" hand position has been amended to "9 and 3" Sources: this safety message brought to you by a North Lincoln Fire and Rescue volunteer.
