Why do legal experts in this section give wrong answers?

Postby chen12 » Tue Jun 19, 2012 3:52 pm

I asked what is the difference between relief and damages. Someone here told me damages is only the injury NOT what you receive as compensation for injury, a loss, etc. That seemed fishy to me I then went and looked up damages in blacks law dictionary. I found out that definition is wrong. Black law dictionary says, "A pecuniary compensation or indemnity, which may be recovered"

Someone else on here told me you can't sue in Federal court using state laws. I then went and did 2 days of research on that at the law library. I found out that you can. There is something called "supplemental jurisdiction". Its even a federal law that is codified at 28 USC §1367. Which came as a result of the US supreme court case United Mine Workers of America v. Gibbs, 383 U.S. 715 (1966).

You probably asked under the wrong category, so, instead of legal minds answering you, the illegal minds had a chance.

Why do legal experts in this section give wrong answers?

There are very few lawyers on here - most of the people who claim to be lawyers/paralegals are not.

In addition, law is a complicated subject. It doesn't lend itself well to a short question-and-answer format. Even extremely knowledgeable people (lawyers or not) here on Y!A have to distill a complex answer down to something a non-lawyer can understand in a general format, because these people do not have all the details of your specific inquiry and do not have the time and the space to give a thorough answer to an extremely general question.

Someone probably told you that you can't sue in federal court using state laws because it's usually true. As you discovered, there are a few (very narrow) exceptions. This is why it is always best to consult a lawyer for legal advice, not Y!A. He or she can take the exact facts of your specific case and give you advice tailored to your situation.

Ahhh I see your problem. You went to look at 28 USC §1367. You should have really looked at 28 USC §1368.2.6.4 subsection V paragraph 321. You would have found all of our answers more much quickly there.

If you were able to find all that information, then you could have done that in the first place instead of asking a question.

Not everyone on yahoo answers is a legal expert and if you want truly accurate information do the research yourself or contact a real lawyer.

Every single category is filled with answers that are wrong, misleading or misunderstood. Live with it.

The answer to your question is YES, there are wrong answers here, but NO there are probably not very many legal experts here.
