Why is Obama allowing bail for Illegal immigrant indicted for murder in Milford DUI death?

WORCESTER (FOX 25 / MyFoxBoston.com) - The illegal immigrant who allegedly hit and killed a 26-year-old man in Milford was indicted for murder Friday.

Nicolas D. Guaman is accused in the August death of 23-year-old Matthew J. Denice, who was dragged for a quarter of a mile while trapped beneath Mr. Guaman's truck, according to Worcester County District Attorney Joseph D. Early Jr.

A Worcester County Grand Jury handed up indictments for second-degree murder, manslaughter while driving a motor vehicle, motor vehicle homicide, wanton or reckless behavior causing risk of serious bodily injury to a child, leaving the scene after a collision causing death, failing to stop for police and operating without a license.

Guaman, 34, was arrested by Milford police after the Aug. 20 collision between a pickup truck driven by Guaman and a motorcycle being operated by Denice. The collision happened at Congress and Fayette streets.

Guaman continued driving after the crash despite witnesses banging on the driver's door and attempting to alert him that Denice was trapped under the truck. Police eventually stopped the truck on Lee Street.

Guaman will be arraigned Nov. 1 in Worcester Superior Court. He is being held on $100,000 bail.


Statement from Denice family:

We believed from the beginning that what happened to Matthew was murder. Matthew was killed by a man who never should have been behind the wheel of a car. We are relieved that the Grand Jury saw the evidence as we did, and we are grateful to prosecutors and law enforcement officials for their hard work in securing the toughest possible charges against Nicolas Guaman. We are confident that today's indictments will pave the way to justice for Matthew.

He is in the country illegally, driving drunk, endangers a child, kills a man and Obamas ice refuse to even issue a detainer, meaning once he makes bail, he can leave the country without any problems from Obamas ice.

He is in the country illegally, driving drunk, endangers a child, kills a man and Obamas ice refuse to even issue a detainer, meaning once he makes bail, he can leave the country without any problems from Obamas ice.
When comes to protecting US citizens & Legal residents from illegal aliens, The President & the federal government has failed us.

It's not up to Obama. He's not the judge on the case.
I am sure that once this person is given bail, he will be guarded very carefully to make sure he does not flee the state. I think the judge should take away his license if he has one. Who may I ask is paying his bail. I don't know of any illegal immigrants with that kind of money. If somebody is lending him the money. i am sure that person will see that he does not flee or that person may be guilty of abetting or something.

I am sure that once this person is given bail, he will be guarded very carefully to make sure he does not flee the state.Just like ICE did here,
MILFORD — U.S. Rep. Richard Neal, D-2nd, said yesterday he plans to ask for an investigation into how a witness to the accident that killed Matthew Denice could have disappeared.

"I'm asking for a full review of the incident from the Department of Homeland Security and Janet Napolitano," Neal said at a press conference at the Milford Police Department.

Police have said Luis Acosta, 20, of 10 Cherry St., Apt. 2, Milford, a passenger in the pickup truck that struck Denice in August, cut off a monitoring bracelet Oct. 1 and likely fled the country.

Nicolas D. Guaman, 34, of 10 Cherry St., Apt. 1, Milford, is accused of driving the truck when it hit Denice's motorcycle and dragged his body a quarter-mile. Authorities have determined that Guaman is a native of Ecuador who is in this country illegally.

Police Chief Thomas O'Loughlin said Guaman and Acosta knew each other but did not elaborate on their relationship. It has been determined that Acosta is an illegal immigrant, O'Loughlin said.

Acosta fled after the accident, and police captured him two days later out of state. He gave a voluntary statement about the incident and was arrested on a warrant for driving without a license. After that matter was settled in court, U.S. Immigration and Customs Enforcement held Acosta on a detainer, suspecting that he was in the country illegally.

They later released him with the bracelet, Police Chief Thomas O'Loughlin said.

Milford police say they were not notified that Acosta had removed the bracelet until they asked Immigration and Customs Enforcement about Acosta when he did not appear for grand jury testimony Oct. 6.

"I think we should have been called (when Acosta cut the bracelet)," O'Loughlin said.

Detectives had spoken with Acosta in person on Oct. 3, but they did not know he had taken off the bracelet. He last used his cellphone that night, O'Loughlin said.

On Oct. 6, police traced Acosta's cellphone to John F. Kennedy International Airport in New York. His phone has not been recovered, O'Loughlin said.

Milford officers are working with Port Authority police in New York to try to find video of passengers boarding flights to Ecuador, O'Loughlin said.

O'Loughlin said Ecuador does not have extradition to the United States, but if Acosta is in the country, "We will go anywhere to bring him back."

If he is outside the country, "We certainly would encourage the Department of Homeland Security to seek him out," Neal said.

The Worcester County district attorney's office sent a letter to ICE telling the organization that Acosta was a witness in the accident, but it is unclear if ICE received the letter, O'Loughlin said.

Neal said he didn't understand how Milford police were not told that Acosta had cut his bracelet until they asked ICE.

Yes they will watch him real carefully ,just like was did in this case.
