Will delivery company find out if I got a speeding ticket in company vehicle? #CALIFORNIA?

Postby kenway » Sun Jul 08, 2012 9:46 am

I got a yellow citation and it gives me a place (court) to appear. It's a 223570 Basic Speed Law. However, the "Registered Owner or Lessee" is not me, and seems to be of some other company. I was accused of going 73 on a 50 mph road. I do not believe that to be the case.

Will anything be mailed to anyone other than me, thus giving the heads-up? Assuming I am cleared of this miscarriage of justice (I will fight the case), and I get no points.

Anyway I work at an car parts company. This would be my first moving violation.

Not immediately. They wrote you the ticket, not the owner of the car. However, I would imagine that all companies who have vehicles would run an MVR on their drivers once or twice a yr.

They will fire you if you don't tell them, but at least if you tell them you have a chance of keeping your job.

I've driven for small companies and big trucking firms. They understand that occasionally you will get a ticket. Honesty is the best policy. I remember a small delivery company I worked for kinda thought it was funny when people got tickets even though they were the ones pressuring everyone to hurry up and run their route. Of course, they didn't want anyone to get too many or insurance would require them to fire someone, but they sure didn't offer to pay for it either.

in canada 1 of the first things the police do is call the company who owns the vehicle and tell them why they pulled you over its done more to cost you hardship at work than it is done for any other reason, it depends on the officer if he is a good cop then it may stay with you only, if he isn't then the place you work already knows and are just waiting the out come of the trial.
not likely you will be dismissed tho more likely if your a good worker they just wont let you drive any of there vehicles for a period of time how long i don't know it depends on company policy

Law enforcement won't inform your boss, but they WILL figure something out when you have to take time off work for the court appearances. YES, I said more than one court date. At your first appearance, you enter the not guilty plea, and they schedule a trial date.

The company will find out about it only if you get convicted and the conviction is reported to the DMV. Communications regarding citations are sent only to the driver, but the company's insurance carrier will be monitoring your DMV record.

You can avoid a DMV point by going to traffic school, which you will be able to do on line without taking any time off of work. In your situation it would be foolish to fight the citation. First of all, to win you would have to show that you were at least going under 55 mph, and that it was safe to drive at that speed, or that you were driving at 50 or below. The odds of a judge concluding that an officer made a mistake of 18-23 mph in measuring your speed are very low.

If you fight it, not only would you have to take time off work to go to court, but although you will be able to go to traffic school automatically now, if you go to trial and lose (which is likely) it will be discretionary with the judge whether to allow you to go to traffic school. Some do, some don't. In your position that is a risk I certainly would not take.
