Will I be allowed into the UK with an EU passport after overstaying on a Canadian?

Postby tupac » Tue Dec 13, 2011 5:56 pm

I overstayed my Holidaymaker visa to the UK by quite awhile. I know it was stupid, but there were extenuating circumstances that I won't get into here. Anyway, even though I wasn't caught leaving, I'm sure that Border Control is well aware of my breech and would surely turn me away were I to try to go back to the UK even as a tourist. Immigration Control did, in fact, visit my former residence two days after I left.
I am now back in Canada and, due to a recent law change in the Netherlands, I am now eligible to claim Dutch nationality and am in the process of doing so. Once I have that passport, will I be able to use it to return to the UK unfettered? Will I be able to live and work there? In the event that I have had a summary conviction passed on me for the overstay, how will I be able to address it? Will it stick now that I'm an EU citizen? Any information anyone has will be much appreciated.

You will be able to travel, live, work or study with no restrictions as a citizen of an EEA member state.

Your previous overstay will only count against you if you attempt to enter as a Canadian citizen.

There is no summary conviction for an overstay. You would have been subjected to an administrative removal which does not require any court intervention. Therefore you do not have a criminal record in the UK, at least not for this issue.

When you receive your Netherlands passport, you will be able to visit anywhere in the EU that you desire without having to apply for any visa. You will also be entitled to live and work anywhere else in the EU, this is your constitutional right as an EU citizen. Just don't travel here on the Canadian passport, as you'll be asked lots of questions at Border Control. If you have a EU passport, you'll go through the green zone (no immigration checks)
