Will speeding ticket cost more if plea not guilty found guilty at court than plea guilty right away?

Postby mace » Mon Apr 04, 2011 10:39 am

I am currently taking a law type of class at my school and this section is on traffic. I ran across this question and have not been able to a definite answer to it.

Lets say that someone got a traffic ticket for speeding on a high way or something. And for the sake of question (let go to an extreme), this guy did 95/65. Now, I believe that will get the person a court appearance unless he is able to pay at site. So at court, will the ticket price (lets say $100) cost more if that person plea not guilty and than found guilty by the judge or just plea guilty.

And on a side note, will the ticket price change (as in go up) if judge have different opinion than the officer that issued the ticket. Like if judge thinks the person should be fined $150.

I live in Illinois, so I'm guessing my class will want the answer that pertain to my state, but any contribution (any other state) are totally welcome.

I understand the most court appearance will require a court fee. My book have general court fees but nothing specific like this, any idea on how much the fee would be for this type of deal?

Thanks!

Driving a 95/65 will get your license taking away on site and have you arrested (in most states). So more than likely you will need a lawyer, so there goes one set of expenses you need to pay.

But other than that, no the judge will not increase the fine. The fine is set at the moment of issuance. All you are doing is trying to fight the ticket. It would be illegal to get punished because you want to fight it.

A speeding ticket fine is usually a graduating amount based on the disparity between the posted speed and the speed noted on the ticket. Whether you plead and pay or go before a judge and are found guilty, the fine won't go up.

Just filling out the documents to go to court will cost more than the ticket. Just pay it and try to be more cautious next time. You likely won't be found not guilty.
