Wisconsin Kid Tax Rebate Check 2008

I have 50% custody and 50% placement of my son. My ex-wife and I alternate years that we claim him on our taxes (per our marital settlement). 2007 taxes occurred to be the year that she claimed him on her taxes as a dependent so she will be receiving the $300 child tax rebate that Bush authorized this earlier February. I actually feel that I am entitled to 1/two of this quantity thinking about that our son is with me 1/two of the year. Do I have a claim to take to tiny claims or do you genuinely feel the judge will rule against me?

My lawyer told me to go to small claims court b/c then if I won the case she would finish up paying the court costs on prime of the $150. Its not a matter of only acquiring $150, its a matter of principal. This is a a single time rebate for households, it does not have anything to do with who claimed the youngster on their taxes it has to do with who pays for the kid throughout the year, which we split appropriate down the middle.

That is just it, I would split it with her b/c this can be an one time rebate, not one thing we get every single year and she foots the exact same quantity of costs for him as I do so she Need to get 1/two of it.

You would seriously consider going to court over $150? Even if you do have a claim, which I doubt, you wouldn't do it in small claims court. You'd do it through the family court where you got divorced.

No, she is entitled to the rebate since she claimed him last year. I am sure if it were you turn, you would not want to split it with her either.

I think your lawyer is incorrect; I think it's going to have to be heard in family court.And anytime some tells me it's the principle I know it's more than that. Seriously, it's $150. it's not worth the grief.

Existence ain't usually reasonable. This scenario likely is some of those times.But, the price of going to trial over this problem likely will exceed what you'd stand to achieve, and of course the bitterness that you may generate.Move on. You'll find better things you may be doing together with your time.
