Worker's compensation case?

Postby albanwr26 » Fri Jul 27, 2012 7:06 am

i was recently injured at my job, was put on WC for a herniated disc and severe SI joint dysfunction. over the course of 5 months i did physical therapy, got a cortisone shot, and i haven't improved. from day 1 the ortho told me surgery could not help me and that 80% of people with SI dysfuction have reoccuring episodes. I was eventually sent for a functional capacity test, in which i fell into a category that is under what my job requires(delivery driver), and since the doctor signed off that i had reached my MMI(maximum medical improvement), my job had to let me go because i could no longer perform the duties. My question is aside from filing for workers comp petition with a lawyer, does the settlement for the injury factor in the loss of job or will i only get what anyone with that type of injury would get. Seems like i should be entitled to more for being injured to the extent of job loss. now i have to basically start over in a new career.

Yes, it doesn't seem fair but its the best to start another career.
I have seen others unhappy not in their profession because of an injury
You compensation may pay for more college eduction and a new start on life,
I think you'll be the happier
