Would the new immigration law aproved by Obama apply to me?

Postby anglesey34 » Tue Jul 24, 2012 2:48 am

I came to the states when I was 12 years old, I studied from 7th grade til half junior high school year and then left to Venezuela (that's where I'm from) when I was 17, after a few years I decided to come back and actually got caught by immigration, so right now I have until Oct. 25th to leave the country or I'll have a deportation order. What I'm wondering if it's the new law can help me since I seem to meet all the requirements or if the fact that I was out of the country for 5 years just makes it impossible for me to apply for this law, I'm 22 right now by the way. Thank you!

You came here legally when you were 12 or illegally? because, how did you leave and come back to the USA, even if they caught you in the airport being illegal, they wouldn't of let you come back and send you back. Most people commenting on this will say the dream act is dead, but its really not. It's not really a "law" its more of an executive order. The order will protect even those that have a deportation order. The application comes out next month so luckily for you it is before October 25th...
The qualifications are : coming here before the age of 16, are under the age of 30 now, no criminal background, is in school and a student, and has been here for 5 consecutive years. You will have to show that you came here before the age of 16 because then you would be unaware of your status, but the fact that you came back knowing your status is going to be difficult. I would talk to a lawyer or someone that knows more about immigration, but that might be expensive. Or just wait for when the application comes out.

No,
you are not eligible for 3 reasons:

1) You left when you were 17.
2) You came back as an adult, which is an actual crime
3) You have a pending deportation order.

Had you never left, you'd be eligible.
