No. You have to apply from within your country of citizenship. It can take 3-5 years of processing, paperwork, proofs of your investment and viability of your business before any visa is issued (IF any visa is ever issued). Since you have overstayed a visa, you are already going to have serious trouble applying for EB-1. Your overstay may very well have cooked your goose but good. Hurry home TODAY - length of your bar to reentry is determined by length of overstay. So the longer you overstay, the longer it will be before you will be allowed to file for any visa application!

go home first ...you have to get the visa from your local consulate
get an aila lawyer first http://www.ailalawyer.com/

if you have overstayed a visa ..you may have a problem

the EB5 ends Sept. 30, 2012 currently
