Going to apply for student visa to the U.S I currently live in Mexico ?

Postby croslea » Wed Dec 21, 2011 8:09 am

I was born in Mexico but moved to the U.S when I was a year old my parents crossed illegally and I am getting punished for that I went to school in California and graduated with honors 3rd in my class I read immigration laws and read that if I leave the states before I turn eighteen I won't get punished when applying for a visa. I left and now I'm applying my question is will I have to show prove of when I left the states when applying for my visa. The reason I ask this is because I'm nervous when I crossed into Mexico I didn't show any paper work or identification I just crossed. I'm applying for a standard visa for a state university. Any information would be helpful actual information coming from a lawyer or person who has experienced this would be greatly appreciated.

It's going to be very hard to get a student visa to the United States. There is a question all visa seekers have to answer:

Have you ever been to the United States ?

When ?

For how long ?

You must answer the above questions honestly. If you lie you will be blacklisted and you might be banned from ever stepping on US soil again.

You are correct that leaving before age 18 1/2 does not result in a ban
but since you have spent most of your life in the US, it is totally unlikely you will receive a visa since you could not establish that you are a bona fide nonimmigrant.

You should be fine if you can prove you have enough money, typically 50k a year so 150k total.

First, you are not being punished for the actions of your parents. Since the U.S. government does recognize that children have no say in where parents take them, unlawful presence is NOT recorded until the child becomes an adult. If you left before you turned 18 (18-1/2 actually), you are free and clear.

First, apply at the school as an international student. If accepted, they will issue you an I-20 form. With that you apply for an F-1 visa at the U.S. consulate in Juarez. The fact that you are in Mexico now is proof enough that you haven't been unlawfully present. If questioned, tell the truth. I'm sure you can provide some evidence of since when you have been present in the U.S.
