Wv tresspassing law? ?

My mom hired a man to build a new deck at our house and he never showed up and smoked weed on his lunch break . I think she paid him 4,000 dollars for labor and supplies but failed to do both . The supplies he bought were total crap. There is more too but im gonna get to the point my mom fired him on a monday and the next day he showed up with another man and said " you will have to pay him to help. " my mom told him no and then he started taking photos of the deck and my mom told him to leave 3 times and he wouldnt and kept takimg pictures so she grabbed his phone and threw it but it was fine . He finally left then my mom called the cops and they came and the cop said how crappy the boards and work was and he said to take him to court . Now the contractor wants to charge my mom with battery even though he was being rude and wouldnt leave our property . He is also threating to have her arrested at work . Can he charge her ? He also wont refund her money her boyfriend had to fix and build it . Sorry this is long but thanks:)
