18 Yr-Old 1st Charge-

Postby Danton » Sun Feb 09, 2014 10:57 am

Our boy turned 18 about the 20th this month. We reside in Kansas, and as juvenile, we've had many detention remains. He was imprisoned for possession of marijuana and paraphernalia. He swears that there was NO paraphernalia, and I actually do know for many that the pot was acquired, many blocks away. I'd like him to invest his amount of time in prison, but, used to do tell him not to plead guilty to something and to request a court-appointed lawyer. Number 1. Was the correct thing to express?number 2. Can you have any idea in regards to what kind of fines he's taking a look at?# 3. I've previously informed him I'd NOT help him out, as I do not trust him in which to stay the state.# 4. Having a Court-Appointed lawyer, and my boy asking not cover, absolutely for your paraphernalia, I know it'll increase the problem, but, would anybody know if the moment he stays, TODAY, would be viewed section of his phrase?Any help will be greatly useful. Our heart is damaged, but I understand I've to be firm this time around. Thanks, KAT

I desired to Hug that judge!! Again Thanks,Kat

Paraphernalia covers a whole lot of items of contraband. This is likely a misdemeanor offense.
Are you certain Section 8 wouldn't allow him at your residence.
My impression is that only felonies are implicated.

Thanks so much for the feedback. I do need certainly to discover if because his dad won't allow him in his home, and I can not have him reside in my home, because it's Area 8., that today that he's 18, and indigent, could that be eligible for court-employed? Thanks so greatly! Kat

It's never a bad idea to consult counsel.
You would have to ask local counsel regarding the penalties as no OH attorneys currently follow these boards.
Yes, time currently spent in custody will be credited against any sentenced imposed for the offenses.

Now that he's an adult only his own financial situation will go towards determining whether he qualifies for court-appointed counsel.Richard

Any drug offense will bar someone from living in public housing, I assume section 8 is the same.
