Accident while parked facing oncoming traffic.?

Postby colten » Mon Jul 09, 2012 8:36 pm

I was parked blind behind a people carrier. I revesered and turn my wheels left, in preperation of puling out. At this point my tyre was clipped by an on coming car.
There was no damage to my vehical at all. And on inspection there was no damage to the other vehical (i would like to add that i am a mechanic, with inspection experience). The police weren't called, we exchanged details and we parted in aggrement that everything was ok.
However, i have now been issued with a claim for £7500 in damages and personal injuries.
First off, I'd wish to know if i'm to blame, and secondly can they do this after the fact.

No one here ever says the other party in an accident caused by them has any damage.

Incredible isn't it?

Just tell your side of the story, and let the insurance sort it out.

You are not in a position to know whether there really was damage or injury, and your opinion is quite likely to differ from that of the person you crashed into (or crashed into you).

On what you say the other side will have difficulty getting £7,500- but they may well get something- you'll have to wait for the investigation- could take months if not years.

If you weren't moving when the other car hit you, I would say that it's his fault. Of course, my opinion, as well as everyone else's on this site, doesn't count in the end. You need to let your insurance company handle this. They will determine who is to blame, and who should pay.

Convey the facts to your insurers and leave them to deal with it. Make it crystal clear that you do not want them to settle with the claimant as it will affect your NCB.

'I was parked blind behind a people carrier'. I would leave that part out of your accident description, if I were you.

Evening,

Unfortunately the world is full of people like this - from what you have said I would say you aren't to blame. The fact of the matter is your insurance company will want picture evidence from both yours and his/her car. Now if your car is fine and so is his then there is no way your insurance company will pay out.

If he has done further damage to his car to try and make it seems like a big accident then they will have a pic of there car and a pic of your car. Your car has no damage his car is toasted - Insurance
company will laugh at the claim.

As for injury .... Lemme guess - Whiplash?

I would think their claim would be dismissed but that's just my opinion.

Best of luck
