Accidentally sold a fake item on eBay ?

Postby forde » Wed Jun 27, 2012 9:31 pm

A couple months ago I bought a bottle of Chanel mademoiselle Coco perfume off the Internet for about £60, I didn't have much money and it was the cheapest deal online by about £10. The website was a little strange but the perfume did arrive in a genuine looking Chanel bottle and box.
It smellt fine too, but for some reason the lid broke instantly - I didn't think much of it..I was pretty eager to open the perfume and use it and I'm a clumsy person anyway!

Having used about 95% of the perfume I have decided to sell it on eBay, not because I wasn't happy with it but because I desperately needed some money. I posted a clear description of the product, with the picture of the perfume and the broken lid.
To my greatest surprise the perfume sold for £50!
Now I have sent the perfume to the buyer and they have gotten back to me telling me that it's a fake and they want a refund (I specified no refunds on the sale). And now I don't know what to do, because I really did believe it was a genuine perfume, now that I have googled signs of fake perfume it does seem to match the description - the colour was slightly darker than supposed to have been and the label isnt as clear and gold as in the shops. But without googling it those things really wouldn't have stood out for me at all!
And on the eBay listing I had posted a very clear picture of the perfume so if this buyer is so good at spotting fakes then why didn't they spot it straight away based on the picture?
I know selling fake items on eBay is against their policy, however I did study law in the distant past and remember in contract law a case where a seller wasn't aware of the fact that he was misselling a product as he genuinely believed it to be something which it was not (within reason) and when the buyer realized and asked for a refund the court ruled in favour of the seller. - not that I'm about to take this to court or anything!
Anyway any advise would be much appreciated!
Thank you

Accidentally sold a fake item on eBay ?

Oh dear, dearest internet colleague, it seems you are in a twee rift here. Well, here is my suggestion, take it if you will, write the disgruntled buyer of your financial predicament and wait to see if they are understanding (after all it is only five quid). Unfortunately, I suppose this will not be the case and you will have to refund the bloke. Hmm! This is truly puzzling, what to do, what to do. Perhaps you can sell something else of yours which you do not particularly need and receive the money that you appear to be in dire need of? Maybe you should contact your siblings or dear friends about your financial distress? Hmm? Move in with your parents? Start getting unemployment checks? Hmm? Attempt to win the X Factor? Record a video of yourself singing Sussudio by Phil Collins whilst juggling seven oranges? Hmm? I think the real issue here is that you are being strangled in your panties by your looming financial burden, not some silly online misunderstanding. Hope this helps, best luck on your future economic endeavours.

If you know it is a fake then yes of course you must refund the buyer: Item not as described.

Stating "no refunds" does not get you out of it, the buyer is still entitled to a refund both under Ebay rules and by law. Suck it up and issue a refund; there's no point asking for the bottle back because you'd have to refund postage too.

If you need to make some money, specialize in something to buy and resell; you must learn exactly what things are worth (otherwise you end up losing money on bad deals) and what faults and fakes and problems to look for and then get to work selling on Ebay. It helps enormously if the items you sell are something you already have an enthusiasm for and general knowledge of. The profits you can make are impressive if you know what you are doing.
