Adding to a contract that was already signed?

Postby tupac » Sat Apr 07, 2012 1:36 am

I enrolled in a school in Utah. I signed a contract stating that financial aid would pay for the entire tuition. I withdrew from the school and now they are saying I owe them six thousand dollars and that since I withdrew, financial aid won't pay. I was never told this until after I withdrew. The owner has also sent me a page that she claims was in my contract which explains I have to pay if financial aid doesn't. The problem is that this page wasn't in the original contact that I signed. She is now taking me to small claims court. Can I get her in trouble for changing the contract???

well since u didn't see that part of the contract and u didn't sign it there is no reason for u to pay her. it is like them trying to make u do something in a contract u didn't sign.

You have to prove it.

You also have to prove you didn't see that particular page, which is going to be difficult.
Ideally, you are asked to initial relevant clauses like that, but this isn't always a requirement.

Hopefully you kept a copy of whatever it was that you signed. All you need to do is show up in small claims court, tell your story, present your copy of the contract, and hope the judge believes your story. You will win if the judge is convinced that extra page was not part of the contract that you signed.
