I am responsible for the last months notice on this contract and I need to leave. How much does a written contract hold up in small claims court. SHe is taking me to court because I only paid her two months and then she did some questionable things but that doesn't matter. I am just curious if I go to small claims court can I fight with the point of view that three months is unreasonable for a massage therapist? There are thousands of other RMT is the city that could take this spot.

YES you need to pay her you signing a contact.... Tell you will pay her but your still leaving.... Next time make sure you read it properly before signing anything....

Generally, if you signed it, you have agreed to it and are bound by it. Perhaps if the landlord had made some promise not to rigidly enforce this rule, either for a limited time, or permanently, and you had acted in reliance on it, then you could demand that she keeps her word. If you had given something to remove this clause, such as a one off payment or some favour, then you could rely upon that.
