Advantages and disadvantages of bringing both a criminal and civil case to court at the same time?

Postby gustav » Fri May 18, 2012 11:10 pm

I was advised not to cross civil and criminal cases at the same time as it can prolong the length of the trials, due to cases getting adjourned whilst the other case takes place. I was told to do the criminal proceedings first then to do the civil matters afterwards.

My cases were:
Domestic Violence which included ABH and assault by beating - Criminal
Divorce due to Domestic Violence aka unreasonable behavior - Civil
and Child Residence - Civil

I did though get a non molestation order and occupation order (which are civil) whilst the criminal matters were going on as there was a change in bail conditions (which are criminal) and I needed them for my own safety.

Hope this helps.
