Afidavit for green card?

My sister in law needs various documents to continue her green card,the paperwork says one of these can ( but does not have to be ) an afidavit from at least two witnesses testifying that her and my brothers marriage is legitimate and for reasons other than to circumvent the immigration laws I have been asked by them to write one..their pprwrk does not specifically state that this afidavit needs to be notarized, and I am aware there are some afidavits that don't, but just in case I am asking does anyone know if this specific situation does require a notarized afidavit? They are currently in town for a visit but live out of state, and I would hate for them to get all the way back home only to discover I was supposed to have it notarized before giving it to them to mail in..

USCIS does not require notarized documents. Please read Instructions for I-751, item 2.5. It just has to have the complete information on the person signing it for you. If USCIS needs to, they will request the person to testify. But the affidavit is just part of a group of documents, so it is not likely that the person will need to testify. Add Birth Certificate of children, insurance that the couple has together, accounts (bank, credit), driver's license copies with the same address, etc. Nothing, not even copies need to be notarized unless the instructions for the petition say so (and they don't).

You do not have to have all of the types listed below as proof of the relationship; supply as many as you like. If you are short on the documents that have both of your names listed on them you MAY include affidavits from people who know you as a couple confirming your marital relationship -- note that they are not required. If you have very little documentary evidence, you may find affidavits helpful.

Yes, it is usually better to notarize anything for the official submission.
