Alberta labour laws help please?

Postby ealahweemah72 » Wed Dec 14, 2011 1:20 pm

Can someone help me out? My friend was telling me about some labour laws in Alberta. I think my work isn't following them. Basically, I get my new work schedule on Sunday. ( got it at 11:30 this morning) and its for the next week ( Monday to Sunday) she told me I need 48 hours in advance before a shift. So I got 27 hours ( before I've gotten 12 hours before a shift. Then I don't usually get a break. My boss says in sitting there all day so I use that as a break. But labour laws says I need 15 miniutes away from the work place. I work a cell phone place and it's not to busy and when it is busy I never get a break. So what should i do? Especially about getting less then 48 hours in advance for knowing about a shift. I just starte this job, it's my first job and ibdont know what to do. Can someone help me out? I went on the law website and looked around but couldn't find it so if you have any websites with the laws Spesfically the exact web page can you please put it in your answer? Thanks!

You will be able to find your answer starting here: http://albertacanada.com/intl-business/employment-standards-and-labour-code.html

Good luck. BTW, I did not find anything about shift change notifications, but I did see information on break periods.

Here's an answer posted for an employee in the UK.

For breaks you might try a 'Back in ten minutes" sign. Boss might object and dismiss you but then you might have grounds for a wrongful dismissal case.

As to adequate notice of shift change, you could only receive info from boss prior to the cut off time. Eg, not take calls during period before shift though again, he might just dismiss you.

Decide how much you want this job what with Christmas coming up. Keep your eye out for other work. This boss is cutting corners he shouldn't but do you want a poor job reference? You might want to make the best of it for now and seriously look for other work. Once you have a new job, perhaps you could report this person to Labour relations then.

Note: In small offices and stores where there is one employee, it is not that uncommon for the employee to have to take short breaks 'on the fly'.

Also call Labour relations for more precise info on labour regulations.
