Help with Labour Laws? (Ontario)?

This guy was a d!ck and I want to get him in as much trouble as I can. So far I have four offenses against him according to http://www.elaws.gov.on.ca/html/statutes/english/elaws_statutes_00e41_e.htm#BK15. He will not pay me. It has been seven days since I was fired and payday was today. I went into the workplace (subway) and asked for the check. He wasn't there so I talked to his wife whom said my check was not there, but everyone else's was. I called him later when he was day and he told me payday was monday, I tried to explain to him that I knew what day payday was and I was already in the store an hour earlier. He hung up on me. I called him two more times and he hung up on me each time. He refused to train me and I wasn't allowed to ask questions, so he fired me on the spot for not doing my job right. I had worked four shifts, one of which was a nine hour shift, and he doesn't give out breaks. I told him I will be in tomorrow to collect my pay check or I'm going to the labour board, I hope he doesn't have it so I can, because I have a lot against him. But my question is this, is the link I gave you up to date, and because I am 16, do I qualify for these rights? What can I do and can I get paid more for the hassle?

Your link doesn't work for me.

First, calm down. Getting worked up is not going to help you with this.

Second, contact the Ontario Employment Standards Board at the link below and report (on Monday morning) that your former employer has not paid you for the hours you worked. Tell them that you attended your former workplace (at your own expense) on the normal payday and that your cheque was with held. Tell them that you were unable to get any commitment as to when that cheque would be ready, and that you are getting the run around.

Third - Contact your former employer by telephone and advise him that you have filed a complaint with the labour board, that he failed to have your paycheque ready on the prescribed date, and that you expect him to courier the cheque to you at his expense at your residence as you have already attended the workplace and he didn't have the cheque ready at that time.

Fourth - If you need the money quickly be ready to cave in on the courier thing, but this should motivate him/her to cooperate.


Talk to the employment standards people about the other "offences", odds are nothing will come of it, but at least they will be able to give you a realistic appraisal of the situation. Lastly, don't use the phrase "I want to get him in as much trouble as I can", it ruins your credibility as it seems you are out for revenge, rather than justice.
