An online game called Heromon that seem similar to Pokemon. Is this game illegal to play?

There is a game called Pokemon World online that copies lots of images from Pokemon games(unless they sprited them from scratch I not sure), but anyhow. While that game is technically operating illegally a DEV is working on an online game called Heromon, to try and get around the copyright, but still have a similar fun game to play. Heromon seems to be cut it REALLY close to close to copyright infringment unless it already does, but does it evade copyright and is it legit. That is what I want to know. I was player of Pokemon world online long ago, left but then wanted to return because I was getting bored of lots of online games I normally played, but my conscience bugs me a lot to play games illegaly. So I hoping that they will make this game legit enough.

Please note that the people who make this game supposedly where using Sweden Servers which evade international copyright law. I live in the US.

As far as your conscience bothering you about playing a potentially illegal game, that's between you and your conscience. as far as whether it is legal or not, your should ask this question in the gaming or legal forums.

no, it would be illegal to distribute, as in to give away or to sell.

If no monetary damages are inflicted, then Nintendo can't and won't sue anybody, and that work of fiction falls into fair use if its non-profit, if it doesn't cost any -potential capital- for Nintendo.

Also Nintendo doesn't seem to care much about plagiarism anyways, people have remade Mario 3 for example, and nobody was sued. check out the game Braid for Xbox360. It even used the same text.

Donkey Kong was also taken from King Kong.
Ocarina of Time is based loosely on The Hobbit.
Mario 2 was not actually Mario 2, it was a different Japanese game with Mario graphics. Yoshi's island is actually Mario 2, and was released in America later.
Final Fantasy 3 is actually Final Fantasy 6.

I could go on and on about the amount of **** Nintendo has stolen and/or ****** up.
