Apartment electricity cut off & consumer rights?

Hello there,

I moved from Chicago to Houston in Mar 2011; I already subscribed the electricity and got the confirmation from PennyPower electric service provider and in the confirmation email they mentioned the confirmation # and on 3/3 they mentioned your service would be on your name and after few weeks(3/25) I received a call from them and they asked $250 security deposit for new account(Seems they didn’t process the order yet!) I don’t have any problem with deposit and they said that they sent email for it but unfortunately I haven’t received it I checked my all junk emails etc and I was expecting anytime first bill from utility company and 3 day usage from landlord.

Any how same day(25th/Friday) when I received call for deposit & when I came back from work my electricity was shut-off – Who did it I don’t know probably apartment management but when I asked them for it they denied they did not.

Can landlord or utility company cut electricity without giving notice etc?

I spent 3 nights without electricity because it is a business matter and have to discuss in business hours(M-F 8-5pm).

Can I take any legal action against them?


Please advise.

No. You are purchasing a product. If you don't pay, they don't have to supply it to you. It is just like a drug pusher to a drug addict, only legal. They make you dependent on their product and then they control you by making you pay them all your money. Only way out is to go cold turkey and quit or "grow your own" by solar or wind power.

There are some northern states that have made it illegal to turn off power in the winter months, to homes who have previously registered to have children or elderly in them, but once spring comes, they can shut it off if you don't pay up.
