I just moved in my new apartment in march and within thAt month & the next month before april I left for school around 6 came Holmes by ten my apartment flooded and it came from the toilet and from the bath tub both overflowed with sewage and it reached all the way to my bedroom & livingroom all the way to my bed which is on the floor (its pillowtopto tall for my daughter) her games which was on the floor ps3 and my rugs I just DId laundry which was in boxes stilleverything have to thrown out sewage..maintenance guy came after hour still of nonstop flowing n snaked it and I cleaned up the feces an cleaned it up (luckily I have a cleaning company I work for so I had a wet vac to get to it I didn't go to work for the next two days cuz stench n overtired n sick throat my daughter has asthma bronchitis n had to step threw it now my apartment has maggot flies we both getting bitten up by these invisible bugs and a constant oder & mold..I researched n got a sections 83.56& .83.60 form I have lots of picturesand videos but then again later 2wks on thus month it overfloodded I've been wanting to resolve it with landlord without legal action but it seems like he just have to come around for other tenants often he is around building but he never came to speak to me or see my out come ..last he told me was that's a naturalthing help me understand my rights and how I can be properly compesated time lost and my property and cleaned it myself emotional stress plus I pay maximum rent 850 there's other things that may not be up to code in my apartment..now I see they are painting the buildings and cleaning around wonder if he knows things are not on the upkeep...today got call about him seeing me to discuss rent...tommorow should u issue him the forms statutes or work a better rent deal I haven't paid him for the Mont of April yet....

Firstly maggot flies are not invisible(otherwise they could not study them could they?) Nature of Things

So, you moved into a new apartment without checking out the LandLord? Tch Tch Tch

He is around but not around? It is called Avoidance.

Lawyer should have been involved as soon as you see things are not taken care of in a timely manner.

He knows everything that is not up to code.. You were not responsible to clean it up unless you were at fault. But when it comes out of the bathtub, something is wrong with the plumbing in the whole building. Many landlords just do minor maintenance and collect rent "for the owner of the building"
Landlords are also given the duty to kick out non paying tenants.. This LL is not being helpful to you what-so-ever. He knows the loops that a tenant must go through to get after the owner. But LL would be cutting his own throat by telling you, so he tries to avoid your situation or calling a plumber in(as this comes out of the owner's profit margin >and basically the owner has told the LL that...to keep the people kind of happy and accepting the excuses put out.

These guys(the owners) are insured for this kind of thing. So, it does not even come out of their pocket..
Your signed agreement is to pay the rent and you have not done that - so he has the Legal right to kick you out.

Read your tenancy agreement/photocopy it and compare it with what he is legally allowed to do.
And what you are legally allowed to do.
You could inform the Health Inspectors and the Safety Board to examine the construction.
It is gonna be a war, but you pay rent to them(a business arrangement), not trying to make friends with him or the LL
