Athroscopic Knee Surgery For Torn Meniscus

A month ago I had athroscopic surgery for a torn meniscus. After surgery I sensed I was not healing a fast as the surgeon and rehab therapist said I should.  After two weeks I was still in significant pain unable to walk except for only short distances with a cane. After two weeks I went back to the surgeon with concerns. He said that the surgery was fine, told me some patients take longer then others. "Stay off the knee for two more weeks, keep it iced and I'll you'll be fine" was his prognosis. It has now been 4 weeks and I am still in significant pain and cannot walk but for short distances with a cane.  With a new MRI in hand I went to a new doctor for a second opinion. The new doctor said MRI shows significant trauma, edema and exposed marrow.  Paraphrasing his words, "a real rough careless job". At this point I have seen two doctors and they say there is nothing they can do.  The damage has been done, the knee will heal given enough time. No one can say how long but it will heal. I try to talk to the surgeon and he will say is there is no need for us to talk, no need for an office appointment he did his job,rest will take care of the problem. His position is "your just one of those 1 in 200 patients that take longer to heal". I am totally upset with the surgeon. He has caused me significant prolonged pain.  He shows no empathy. I never thought that I would want to sue for malpractice.  I don't need the money, but I feel strong that this guy should pay for his careless work.    Some should let him know that he can't do this kind of work and get away with it.  Do I have a case?

If the second surgeon's opinion is correct(test, any other surgeon would say the same thing), yes, you do have a case. However, it would only be viable(ie:worth big bucks) if you have suffered significant and permanent damage. Too soon to know that and hopefully, you will heal up. If you don't.........give it upwards of one year.......then you might want to consult a medical malpractice lawyer. Caution: in your State the Statute of Limitations may be only one year so you would need to act sooner if you don't heal. Good luck
